Klimhal en directeuren veroordeeld voor dodelijke val 11-jarige jongen

Today the Amsterdam District Court (Criminal Chamber) handed down its verdict in the "Climbing Wall" case. In this sad case, a boy fell 14 meters down during a children's party because it turned out he was not properly secured. This became fatal to him. Arlette Schijns, Irene Timmermans and Nicole Hoogenboom assisted the bereaved families in the criminal case in which the legal entity and two directors were prosecuted for culpable homicide.

The Amsterdam court reached a conviction of all three defendants as supervision was inadequate and essential precautions were missing. Leaving securing while climbing to an inexperienced parent, while the supervisors are busy baking pancakes, among other things, is irresponsible. A painful conclusion, now that the death could have been prevented.

In the case of the parents, the claims for compensation of both affection damage and shock damage were granted, both with respect to the damages and (part of the) costs incurred and loss of income. The verdict is satisfactory, but is only a very small plaster for an immense wound.

MH17 – tien jaar na 17 juli 2014

Wednesday, July 17, 2024 will mark 10 years since the relatives of flight MH17 received the worst imaginable news about their loved ones.

KRO-NCRV has produced a documentary series about the fate that befell the occupants of flight MH17 and their loved ones. This four-part series can be seen daily from Monday, July 15, 2024 at 10:05 p.m. on NPO2 (https://kro-ncrv.nl/programmas/de-echo-van-mh17).

Arlette Schijns is one of the interviewees. She acted in the criminal trial for the more than 160 clients, next of kin of more than 90 occupants of flight MH17 that Beer advocaten is authorized to assist.

Civiele rechter laat zich uit over shockschade

On Feb. 27, 2024, the civil chamber of the Arnhem-Leeuwarden Court of Appeal handed down a ruling in a civil appeal of a criminal case involving the shock damage claim of the next of kin of a girl killed by two underage boys at the age of 14. The judgment is unusual and relevant to legal practice for a number of reasons.

It is the first time a civil court has ruled on a shock injury claim under the Supreme Court's new regime since the Hoogeveen and Buterwei ruling;
The court addresses whether or not the confrontation in the morgue was “unanticipated.” The court says something important about this:

“Even if the confrontation was not unexpected and they were prepared for the sight of their (dead) daughter and sister, their statements about what they saw and experienced show that they did not or could not have prepared for the shock of confrontation, quite apart from the question of whether that led to a different

reaction would have resulted, which, in the case of the parents, also factors in that all of this occurred within a time frame of less than 12 hours.”

The court addresses the concur between the affection damage claims already awarded - and the shock damage claims and awards an amount of 20,000 euros p.p.

Arlette Schijns assisted the next of kin in the civil appeal. Ruth Jager assisted the next of kin in the criminal trial.

Publicatie Arlette Schijns: ‘Naar een evenwichtig compensatiestelsel misdrijfschade’

Last month, published Arlette Schijns a new article in the journal Liability, Insurance & Damage. In the article, she discusses the recommendations of the Donner Commission to improve the compensation system for victims of crimes and develops two lines of thought for a future restructuring of this system.

The first line of thinking boils down to repositioning the Damage Fund for Violent Crimes, which is at the front end of the system a first suplier could become (partial) compensation, with recourse to the perpetrator through the criminal process.

In the second school of thought, the government, as the system responsible party, could, in addition to the public compensation system, push for the development of more compensation options through the private insurance market.

Ernstige gezondheidsschade door Janssen vaccin

Laura-Jean van de Ven is advocating for a client who suffered serious health damage from a Janssen vaccination. An article in the Financieele Dagblad exposes the problems of people like this client, who have been in solidarity with society by getting vaccinated, and are now left with damage.
