This week, the journal Traffic Law published a paper by Arlette Schijns about the first party insurance for traffic accidents. The publication builds on the lecture that Arlette Schijns gave at the 12th Groningen Personal Injury Congress on Oct. 1, 2018. In the contribution, Schijns discusses the undeniable advantages of claim settlement through first-party insurance. But she also - against the background of the functions of liability and compensation law and against the background of the material and immaterial needs of victims - places critical comments on this alternative compensation mechanism. By taking a look at the Swedish model of traffic insurance, she indicates how these criticisms can be met.
Arlette Schijns previously published about the possibility of first-party insurance as a compensation mechanism for crime damage. See also her article in TVP.
