Traffic victims often get compensation for their losses
For victims of traffic accidents in the event of liability, there is often a guarantee of compensation for their damages. After all, in the Netherlands it is mandatory for license plate owners to take out WAM insurance for their motor vehicle. In practice, it is almost always the WAM insurer who pays the compensation. Should the WAM not provide coverage for whatever reason, non-motorized traffic victims can appeal to the Motor Traffic Guarantee Fund in the event of an accident with a motorized vehicle. For example, if the perpetrator drove on, was not insured or was driving a stolen motor vehicle.
Victims violent or sex crime dependent on offender's assets?
How different is this for victims or survivors of a (serious) crime of violence or vice. If a victim wants to recover his or her damages, it turns out that not all perpetrators are insured. This is because liability insurance for private individuals is not mandatory in the Netherlands. And even if this "AVP insurance" is already in sight, insurers often fail to provide coverage because of the so-called "intent clause. This clause in the insurance terms stipulates that there is no coverage if there is intent, which will often be the case with criminal behavior. Therefore, the victim seems to depend on the offender's own assets and, in a civil personal injury case, bears the risk that this offender is a "bald chicken. The contrast between getting your justice as a victim and getting your justice could hardly be greater.
Possibilities of compensation for violent or moral crime
Fortunately, a victim does not have to be left empty-handed and there are still options for actual financial compensation, such as damages and loss of income. The victim or survivor can apply to the Damage Fund for Crimes of Violence for (limited) compensation. But the criminal process also offers possibilities.
The victim or next of kin may intervene in the criminal process that takes place between the prosecution and the accused. As an aggrieved party in the criminal proceedings, the victim or next of kin may ask the court for compensation. In doing so, the judge may (upon request) impose a compensation measure and advance settlement in the event of awarded compensation. This means that the Dutch State guarantees compensation if the convicted person fails to pay, for example because the convicted person is a "bald chicken. The CJIB will (continue to) try on behalf of the state to recover the damages from the convicted person. The victim does not have to wait endlessly for this: after eight months, the compensation awarded by the court is paid to the victim or survivor.
