Let law rule

On behalf of relatives of the victims of flight MH17 a complaint has been filed with the European Court of Human Rights (ECHR). The core of the complaint by relatives is, that Russia violated human rights by shooting down flight MH17. AND then washing its hands in disinformation. The similar complaint from the Netherlands is being heard together with several complaints from Ukraine about Russia.

When exchanging arguments with Russia in writing, we lawyers draw on more and more formalities and details in case law. Hope in this was with me, that after reading our papers the ECHR had all the information it needed to judge Russia. What was certain was that the average reader would drop out after one page.

It would be different, if the average reader was present at the ECHR hearing today, and was allowed to listen to the representative of several European states: Henriette Busch.

She made clear what the European Convention on Human Rights stands for at its core. For the promise the members of the Council of Europe have made to each other and their citizens since 1950: no war or human rights violations within our control.

In retrospect, I would have liked our final trial document to consist of just that message. On one page. Law - in whatever form - is meant to provide peace and security to all. I would like to trust that at the Council of Europe, formalities and justice always conform to that.
