Traffic accident in the United States

A moment of inadvertence changed Sandy's* life on April 23, 2019: she was hit on that day in her rental car by a Ford F150 driven by a contractor whose main concern was the feed on his phone. At the time of the road accident Sandy spent several days in Atlantic City as part of a well-deserved vacation. Sandy was making a career with the Dutch government and was scheduled to start in a new position after the summer. The accident resulted in Sandy becoming totally disabled, her relationship strained and her social life shriveled.

Procedure and mediation

Sandy contacted me some time after the accident. Through our international network I found a specialized attorney in New Jersey who was willing to help Sandy. Working closely together, we prepared court proceedings, including hearing witnesses and medical experts in a deposition. After the subpoena was issued, we reached an agreement with the insurer of the causer of the accident to explore settlement options under the guidance of a mediator. The mediation led to agreement on compensation for Sandy's material and intangible loss.

Collaboration with American lawyers

I work relatively often as Co-Counsel together with lawyers in the United States. Our division of roles is clear: the American lawyer is primarily responsible for everything around the actual proceedings (although I can rarely keep my mouth shut during the hearing of witnesses or experts), I primarily assist our client and take care of collecting evidence. Such cooperation between lawyers requires trust and it is important that egos are not too big. What helps is genuine interest in each other's jurisdictions.

American Association for Justice

My fascination with (the peculiarities of) the American legal system dates back a long time, from when I worked at a law firm in Washington, DC. I am a member of the American Association for Justice, the leading American professional association of Trial Lawyers; since this summer I have been on the board of the International Practice Section. This year, the Annual Convention of AAJ place in Philadelphia. Four days back to school is no punishment for me, especially with speakers like Mark KosieradzkiPatrick MaloneAndrew MalonyElise SanguinettiMichelle Simpson Tuegel and David Wenner. Equally important is establishing contacts with lawyers from different parts of the United States and the rest of the world; this forms the basis for future collaborations in cross-border cases.
