When care fails, damage comes to light

On July 29, 2000, the then one-year-old Valentina became seriously ill. Her mother called the on-call medical service several times, but each time was dismissed by the receptionist. Only after four hours was she allowed to come in. By then it was too late: Valentina was in septic shock from a meningococcal infection. Hospitalizations and surgeries followed, ultimately resulting in the amputation of her left hand. Her legs also grew crooked due to infections in her growth plates. Her body, life, and future were permanently altered.

A complex medical and legal puzzle

In 2012, I became involved through a colleague who was retiring. The medical error had been acknowledged, but the causal link was still disputed. Thanks to expert examination, it became clear that Valentina would have suffered residual effects even without the delay, but to a lesser extent.

Result

Thanks to expert examination, it became clear that Valentina would have suffered residual effects even without the delay, but to a lesser extent. Ultimately, this led through the doctrine of lost chance to a settlement whereby 70% of the damages are compensated.

Although much damage has now been recognized, obstacles remain. For example, a suitable home must be found in The Hague: ground-level, wheelchair-accessible with an underrideable kitchenette and a large bathroom for shower chair, etc. However, the insurer wants additional research before Valentina gets that suitable home. Incomprehensible, because her limitations have been extensively documented by medical specialists. But we keep fighting, together. Because it's not just about money, it's about recognition, peace of mind and perspective.
