Vacation ends in disaster on water

On the last day of their journey through the northwestern United States, Fenna and Günter board a Duck boat - a tourist amphibious vehicle suitable for both land and water. But what should have been a relaxing conclusion turns into a nightmare on a bridge. Due to a technical defect, the driver loses control. The Duck boat collides with a tour bus. Six people die; dozens are injured. Fenna and Günter are seriously injured.

The personal impact is lasting

Fenna suffers severe orthopedic injuries. Günter maintains memory problems and difficulty concentrating. Both also suffer from psychological problems. Their life together, for more than forty years, is completely turned upside down. They must learn to cope with limitations, fears and insecurities previously unknown to them. Their relationship changes forever.

Why this case touched me

I travel with Fenna and Günter to Seattle for medical research and preparation for legal proceedings. We spend weeks together. I see up close how hard they fight to reshape their lives. Their humor, perseverance and confidence make a deep impression. For me, this has long since ceased to be just about legal help: it is about people.

Why they hired a personal injury lawyer

Fenna and Günter faced large commercial parties who denied responsibility. They themselves had no way to fight that battle. They were looking for someone who was willing and able to carry their case, even in a different legal system. Someone who would stand beside them.

Liability was complex and cross-border

The accident happened in the United States, the vehicle was owned by a local entrepreneur, but the formula came from a large franchise organization. Both parties appeared to have been aware of the technical risk for some time. Yet necessary adjustments were not made. The liability question was not easy after all, not to mention the challenges of litigating in another country with jury trials.

My plan of action

Together with the American law firm Stritmatter, we initiated a class action on behalf of 43 victims. We collected medical reports, engaged experts, and prepared witness hearings. Fenna and Günter traveled to Seattle to tell their story themselves in court. Everything revolved around evidence, preparation and commitment.

How I look back on this case

This case teaches me how important international cooperation is. And how far you can get together if you trust each other. For me, it reaffirmed why I am a personal injury lawyer: to assist people like Fenna and Günter when they can no longer do it themselves.

What Fenna and Gunter thought of my efforts

During our last days in Seattle, Fenna said: “We are like loose threads that are easy to break. But if you have a good bond, you become strong like a braided cord. Together you can persevere and win. That's how I feel about Günter and me working together with Bojan.”

Result

The jury ruled that the Duck boat-companies are liable for Fenna and Günter's (and the other victims') damages. Although the companies wanted to appeal, a settlement was eventually reached for all the victims. Fenna and Günter got what they were entitled to. With the compensation, they don't have to worry about the future. That means financial peace, but above all recognition. That what happened to them matters. That they are taken seriously. That recognition is just as important to many victims as money.
