All about mass claims
In recent years, mass tort claims (also called mass claims or collective actions) have frequently been in the news. More and more people are joining collective lawsuits against companies or governments that have harmed large groups. Such cases play an important role in protecting human rights and addressing large-scale damage. Think of the consequences of environmental pollution, dangerous products, or serious disasters. Individually, it's often difficult to take action against these – but together you stand stronger.
What is a mass claim?
A mass tort claim is a joint legal action in which a large group of people take action against the same party responsible for the damage. This could be a government, multinational corporation, or manufacturer. Instead of everyone starting a case individually, victims join forces. This increases legal pressure and improves the chances of recognition and compensation.
Since 2020, the Law on Settlement of Mass Damages in Collective Action (WAMCA) provides a solid foundation for this. This law makes it possible to claim compensation on behalf of an entire group of victims – for example, in cases of environmental damage, defective medical products, or government negligence.
The role of Beer advocaten
Beer advocaten is known for its involvement in complex and socially relevant mass tort cases. We assisted victims of the MH17 air disaster, the Q fever epidemic and the Probo Koala environmental disaster, among others.
Our commitment is always the same: to do justice to people who have suffered harm, to obtain recognition, and to improve the system so that the same thing doesn't happen to others.
Mass damage can occur across various areas of law. Below you can read more about the main types of cases in which Beer advocaten is active.
Environmental disasters and exposure to toxic substances
A sudden environmental disaster or prolonged exposure to harmful substances can cause serious health problems. In the Probo Koala case, we represented those affected by health damage resulting from illegal waste dumping. Read more about environmental disasters and toxic exposure.
Disasters in aviation, shipping and public transportation
Beer advocaten represents victims and survivors who act together after a major accident involving an airplane, ship, train or bus. An example is the MH17 disaster. We also assisted victims of the train accident near Voorschoten. Read more about disasters in aviation, shipping and public transportation.
Damage from epidemics and government failure
When the government violates its duty of care, such as during a large-scale disease outbreak, the consequences can be severe. For example, on behalf of more than 250 victims of the Q fever epidemic, we are holding the government liable for negligent oversight or actions. Unsafe medical devices and medications
Defective medical devices, such as a faulty implant, or a medication with serious, undisclosed side effects can cause permanent injury. In the Vioxx proceedings, we assisted victims who suffered harm from a medication that caused heart problems. Read more about unsafe medical devices and drugs.
