Sandy drives through Atlantic City in a rental car while on vacation in the United States. A contractor in a Ford F150 is paying more attention to his phone screen than to traffic. In an instant, Sandy's life changes: she is hit from behind. What follows is the beginning of a difficult chapter in her life.
Injury, work and life: everything falls away
Sandy had just built a fine career with the Dutch government. After the summer, she would start in a new position. But the traffic accident throws everything upside down. She becomes completely disabled, her relationship comes under pressure and her social life comes to a standstill. From an active, committed professional, she turns into someone struggling to stay afloat.
Why this case sticks with me
I saw how hard Sandy fought to keep a grip on her life. She wanted to tell her story, but also look forward. The physical and mental blow of the accident was huge. It hit me how quickly you can lose everything - just because someone else isn't paying attention.
Why Sandy hired a personal injury lawyer
Sandy was facing an American counterpart, in a legal system she did not know. The legal distance felt as great as the geographical one. She was looking for someone who would guide her, guard her interests and translate her story into a legal strategy. I was allowed to take on that role.
Establishing liability: cross-border teamwork
The driver of the Ford F150 was distracted and therefore liable. We were able to work with a specialized attorney in New Jersey. In the US, there are different rules, different procedures - and often a different pace. For Sandy, things could not go fast enough. And I understood that all too well.
My approach: preparation and collaboration
Together with my American colleague, I prepared a procedure. We heard witnesses, had medical specialists testify, collected evidence. After the subpoena, we decided - in consultation with the other party - to start a mediation process.
What I learned from this case
International cases require more than legal knowledge. You need to be able to cooperate, build trust with colleagues from other countries, and most importantly, convey your client's Dutch story in another jurisdiction.
